These Terms of Service ("Terms") govern your access to and use of the Solscribe community solar subscriber platform and related services (collectively, the "Services") provided by Zia CS Services, LLC d/b/a Solscribe ("Solscribe," "we," "us," or "our"), a New Mexico limited liability company. Zia CS Services, LLC is an affiliate of Affordable Solar Group, LLC and is the legal entity that contracts directly with community solar subscribers. Rooftop and commercial solar installation services are provided by Affordable Solar Group, LLC under its own separate terms.
BY ENROLLING AS A SUBSCRIBER, CREATING AN ACCOUNT, OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND BY OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts.
To subscribe to a community solar project through Solscribe, you must:
- Be a residential or small commercial electric utility customer of PNM (Public Service Company of New Mexico), El Paso Electric, or Xcel Energy (SPS) in New Mexico;
- Have an active utility account in your name at a qualifying service address;
- Not already be enrolled in another community solar project that would cause your total subscribed capacity to exceed 150% of your average annual electricity consumption; and
- Meet any additional eligibility requirements established by the applicable utility or the New Mexico Public Regulation Commission ("PRC").
Income-qualified subscribers must additionally meet the income eligibility criteria established under NMSA 1978, Section 62-16B and applicable PRC rules, and may be required to provide documentation of eligibility.
2. Description of Services
Solscribe provides a community solar subscriber management platform that enables eligible customers to:
- Enroll in and manage subscriptions to community solar projects ("Solar Farms") developed and operated by Affordable Solar Group, LLC and its affiliates;
- Receive monthly bill credits from their electric utility based on their proportional share of the energy generated by the Solar Farm to which they are subscribed;
- Access account information, subscription details, and billing history through the Solscribe subscriber portal; and
- Communicate with Solscribe customer support regarding their subscription.
Solscribe is a subscriber management and enrollment platform. We do not generate, transmit, or distribute electricity. Bill credits are issued by your electric utility pursuant to your utility's tariff and applicable PRC rules. The amount and timing of bill credits may vary based on the Solar Farm's actual energy production, your utility's billing cycle, and applicable regulations.
3. Enrollment and Subscription Agreement
3.1 Enrollment Process. To subscribe, you must complete the enrollment form at solscribenm.com, provide accurate and complete information, and agree to these Terms. Enrollment is subject to availability of subscription capacity at the applicable Solar Farm and confirmation by Solscribe.
3.2 Subscription Agreement. Upon confirmation of your enrollment, you will enter into a Subscription Agreement with Zia CS Services, LLC. The Subscription Agreement sets forth the specific terms of your subscription, including the Solar Farm to which you are subscribed, your subscription size (in kW), the applicable bill credit rate, and any income-qualification terms. In the event of a conflict between these Terms and your Subscription Agreement, the Subscription Agreement controls.
3.3 No Credit Check. Solscribe does not perform credit checks as a condition of enrollment.
3.4 Renters. Renters are eligible to subscribe. You do not need to own your home or have permission from your landlord to enroll, as the subscription is associated with your utility account, not your property.
3.5 Transferability. If you move to a new address within the same utility service territory, you may transfer your subscription to your new address. If you move outside the utility service territory, you may cancel your subscription without penalty.
4. Billing, Payments, and Cancellation
4.1 Bill Credits. Bill credits are applied directly to your utility bill by your electric utility. Solscribe does not collect payments from subscribers for electricity. You continue to pay your utility bill directly to your utility company; the bill credit reduces the amount you owe.
4.2 No Upfront Cost. There is no upfront cost, installation fee, or equipment purchase required to enroll in Solscribe community solar.
4.3 Cancellation. You may cancel your subscription at any time without penalty by contacting Solscribe at (505) 944-4220 or [email protected], or through your subscriber portal account. Cancellation will take effect within the timeframe required by your utility's tariff and applicable PRC rules, typically within one to two billing cycles.
4.4 Subscription Size Adjustments. Solscribe may adjust your subscription size to comply with applicable utility tariff requirements, PRC rules, or to reflect changes in your electricity consumption. We will notify you of any material adjustments.
5. SMS Communications (TCPA)
By providing your mobile phone number and checking the SMS consent box during enrollment, you consent to receive recurring automated text messages from Solscribe (Affordable Solar Group, LLC) regarding your community solar subscription, including enrollment confirmations, monthly bill credit notifications, account updates, payment reminders, and program information.
Message frequency varies. Typically 1–4 messages per month. Message and data rates may apply.

Consent to receive SMS messages is not a condition of enrollment in community solar.

6. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at (505) 944-4220 or [email protected] if you suspect unauthorized access to your account.
7. Acceptable Use
You agree not to use the Services to:
- Provide false or misleading information;
- Attempt to gain unauthorized access to any part of the Services;
- Interfere with or disrupt the Services or servers or networks connected to the Services;
- Use automated tools to scrape, crawl, or extract data from the Services without our express written permission; or
- Violate any applicable law or regulation.
8. Intellectual Property
The Services and all content, features, and functionality thereof, including but not limited to the Solscribe name, logo, software, text, graphics, and data, are owned by Zia CS Services, LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
BILL CREDIT AMOUNTS ARE DEPENDENT ON ACTUAL SOLAR FARM PRODUCTION AND UTILITY TARIFF RATES, WHICH MAY VARY. SOLSCRIBE DOES NOT GUARANTEE ANY SPECIFIC LEVEL OF BILL SAVINGS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZIA CS SERVICES, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL AMOUNT OF BILL CREDITS YOU RECEIVED IN THE THREE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Zia CS Services, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any applicable law or regulation.
12. Termination
We may suspend or terminate your access to the Services at any time for any reason, including if we believe you have violated these Terms. You may cancel your subscription at any time as described in Section 4.3. Termination of your account does not affect any rights or obligations that arose prior to termination.
13. Governing Law and Venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services that is not resolved through arbitration shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico.
14. Dispute Resolution
14.1 Informal Resolution. Before initiating any formal dispute proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
14.2 Arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in court for claims relating to intellectual property or unauthorized access to the Services.
14.3 Class Action Waiver. YOU AND SOLSCRIBE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, where required by law, by sending you notice via email or SMS. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.
16. Miscellaneous
These Terms, together with your Subscription Agreement and our Privacy Policy, constitute the entire agreement between you and Zia CS Services, LLC regarding the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
